Neither statement is correct. Fundamental Duties are in Part IVA (Article 51A), not Part III, which deals with Fundamental Rights. They were added by the 42nd Amendment Act, 1976 on the recommendation of the Swaran Singh Committee. The 44th Amendment (1978) removed the right to property from Fundamental Rights.
